Almost 2 years ago I sold some very rare NOS 442 parts to Ron Memmer of Ron's Classic Cutlass. Ron wrote me 2 checks. He later texted me that he could not cover the checks. The following are the texts he sent: On 8-7-2019 "Due to a cashflow problem it might be awhile before I can pay you. I will get you paid just give me some time". On 8-21-2019 "No sir no good now I have a problem with a guy thats doing a frame off restoration on my 69 Hurst Olds and needs money to keep it going and as soon as I can I will pay you in full". I haven't heard from him since. It is illegal to write a check you can't pay. I am not a business, just a car guy. A word to the wise, think long and hard before giving him money. A note to the owners of this forum: I will be happy to show you proof of his texts. If you shelter his behavior by deleting this post, you are enabling this irresponsible activity to the detriment of alot of honest Olds enthusiasts.
Yes it is illegal. I don't know where you are located and where the guy is located but call your local Sates Attorneys office or prosecutor or whatever they are called in your area and ask them. You might have to file in the guys state depending on where they decide the location that the actual crime happened. Depending on the amount it could be a felony. I would not wait very long either as there might be a time limit on reporting it.
Sure sounds Ike a Chump move. What the hell is wrong with people?? He damn good and well when he penned those checks he couldn't cover them. Still no payment or reply? Who would possibly stick up for that kind move?

I had that happen to me a few years ago. A guy wrote me a check and then moved from Washington State to Florida. The check was bad. The county attorney's office where I lived in Washington had what they called a "bad check program". I followed through with the county attorney's office and they wrote a real nice letter to the guy in Florida telling him in no uncertain words that he needed to make the check good. As well, the county attorney's office told me they didn't think they could do anything with the guy having moved to Florida if the guy in Florida didn't respond. Fortunately, the guy in Florida must have been given a different impression as he made the check good. That might be an avenue to pursue for you if your county or state has such a program. I had one other situation just the same except the bad check writer stayed in the state and didn't respond to the county attorney's office. The county attorney's office followed through and that bad check writer had to make the check good, pay the attorney's office a fee of $75, AND attend remedial check writer's class for a week!

Well as said 2 sides to every story but he does set up at Carlisle Pa. swap. Lots of overpriced goodies on his table some priced at thousands of dollars, that you could pick up in lieu of cash if he is that bad off, which I highly doubt! He stiffed me once on Ebay, bought something and when I told him shipping cost I never heard from him again.... Never bought from him and don't ever plan on it either....
You did not sell him the parts if they were never paid for. The parts are still yours. Demand your parts back, take the local sheriff with you to retrieve them. Guys that build on the backs of others are low life pieces of shizzy.

I have had dealings with Ron for both buying and selling and never had any issues... I am curious why the OP didn't just deposit the checks within a reasonable time frame and let them show insufficient funds... Recourse would have been much easier had that transpired... As for not hearing from Ron since the 8/21/19 text and the OP taking no action during that time frame, at least that was mentioned, was basically letting Ron off the hook...
Jurisdiction for initiating criminal prosecution lies in White County, Indiana. Sometimes, but not always, criminal prosecution can result in restitution to the party issued a bad check.

For civil pursuit of an action for breach of contract, jurisdiction may exist both in your state and county and in White County, Indiana. In either case any judgment obtained would need to be pursued in White County, Indiana. Many small claims court statutes would require the venue to be in White County, Indiana.
If I was standing in your shoes, I would brush up on the applicable statutes of limitations.

I've been dealing with Ron for over 20 years, his '69 H/O was finished last year in Phoenix. You can find him at the OCA Nationals in Tennessee this August. He always has a wad of cash with him.

They will advise you what you have to do.
I had to do this with a guy in Rhode Island, got a money order about a week after the Sheriff showed up at this door with a subpoena

Not true. The parts belong to the recipient irrespective of payment. You can not lawfully take your parts back. Sounds illogical, but that is the law.
Obviously two sides to a story but sounds like you the seller are to nice of a guy..I never would take personal check unless I knew the person, cashiers, check, money order or paypal.. but if all is factual the buyer is a piece of **** and needs his *** kicked..period, then take the parts back.. in our hobby you have to trust for people, but you also got to use some common sense. You mentioned they are very rare parts, so I would assume expensive? I wish you the best but I doubt unless he lives locally you’re ever going to see anything, however somebody said he goes to some of these shows and has a table out, show up and start taking anything of value. Jerks like this need eliminated from the hobby.

What process does Ron pursue if a customer buys some parts from him and the check bounces? I realize that some of the opinions were posted by friends of Ron, but illegal behavior is wrong and does not deserve loyalty. As I mentioned previuosly, I am willing to show the texts to anyone who needs to see them to be convinced.
I can attest to RM being a piece of **** when it comes to wheeling and dealing and going back on his word. Ironicially, it was about 69 H/O parts in Hemmings Motor News. Yes, it goes that far back. I've hadn't had any use for him in over 20 years. I'm so thankful I didn't get suckered into his web of bullcrap. I can't recommend the guy for anything.

Well there you go. People like him try at treat certain people good to get them on his side. Then he screws other people hardcore. Seen it before in other arenas.

FWIW, there are instructions in my estate plan that, on my death, none of my remaining stock of NOS parts are to be sold to Memmer. Yes, he sometimes has stuff no one else has, but when I had a difficult-to-plate part redone for less money than he wanted for a take-off...

Writing a check with insufficient funds is not necessarily a crime, it is an overdraft, subject to bank overdraft fees.
In order to fit into a criminal statute, the payor either knew or should have known that at the time the payor wrote the check to the payee (you), the payor had insufficient funds for the check to clear the bank.
In your case, you did not help yourself by failing to deposit your checks. If you deposited the checks and one or both checks were returned insufficient funds, you would have a stronger case by notifying the payor in writing, and if the payor didn't fund his account to clear your check(s), you would be in a better position.
You do however, claim to have documents from the payor requesting that you refrain from depositing the payors check(s).
You will be more productive, instead of writing to the members on this site for a resolution, contact the authorities identified in Tri-carbs post number fourteen (14) to start.
Time is of the essence. The statute of limitations in each state vary. If you blow the statute of limitations, you have no chance of any authority investigating the merits of your case, and any chance of recovery.

Not getting paid BEFORE letting parts go is where the OP went wrong here, IMO. Especially if it's some high dollar items. You think RM would send you any parts unless he had your $$? Chalk it up as a rookie mistake and move on. You can trust people until you get screwed. Then you learn the hard lesson and adjust your payment policy.
Would I drink a beer with him? Sure. He's never been a bad guy personality-wise the few times I've been around him, but I will never seek him out looking for parts. I don't give a **** if I have to walk waiting on finding a part, I'll never knowingly give him any of my money.

We have a new member who posts one other time and then craps on someone and you jump all over it that is what I call unreal.
I am not siding with anyone on this issue and don't have an opinion either way since I wasn't involved in the transaction. There are plenty of legal options for the OP to use but coming here for legal advice is not the place where I would start.
I don't know Memmer beyond one purchase attempt. There are better resources for what he has. He may have some rare stuff. Others do, too. I was turned off by his demeanor, attitude and sales pitch. He basically pressured me (not a direct quote, but the gist...) "you need to buy this from me, now. These don't come along everyday." I obtained what I needed in great, if not NIB, shape (one broken/plastic-welded mount point that doesn't show) for less than a third of Memmer's price. I did this by being patient and continuing my search.
