Dude's a moron. Never buy something with expectations of more later. He probably was pressured by being told they'd sell to someone else. They say they'll find the transmission, then you pay 50% and take custody of the car. That gives them motivation to get it for you.

What does the sales contract say about the original transmission?

If it isn't in writing, it's a non-event. If it is in writing, go to court to enforce the terms of the contract.

How tough can this be?
