What would you do? Sold a car.
Hello all.
I would like some of your comments/ideas on what I should do next.
I sold a Hurst on ebay back in October 2012 for $2500.00 to a guy up in Michigan. I'm in Nebraska. The guy sent me $500.00 right away. Have been emailing and phoning him and 2 months ago sent me another $500.00 for storage fees.
This car thing should have been done along time ago.
What would you do???
Wait???
Resell the car????
Thanks, Mike

Did you have an agreement to store the car for him? So far he's paid you a non refundable deposit and another 500 to hold the car for him. Have you agreed to holding the car for him? You both need to be on the same page before re-listing the car.

Was it clear the $500 was a NON-Refundable deposit? Was it clear the second $500 was for Storage and at what rate? I think you need to make it all clear and put a deadline to the deal. If he does not pick it up by the deadline have it clear that he has abandoned the deal and move on.
Make sure it is all black and white and very clear. A storage spot for a car can run as much as $250 a month. That is extreme. But, he has abused your passivness so far.

Send him a Certified letter, preferably written by a lawyer, stating that you believed that you had sold him the car on X date, you held the car for him in good faith, have forgone other opportunities to sell, and, since he has now taken more than a reasonable amount of time to complete payent, if you do not receive payment in full, free and clear, by Y date, you will consider the sale to be null and void and will resell the car and keep his nonrefundable payments.

I needed it out of my garage. It doesn't have a back window and the T-Tops leak so I took it to a storage facility(Nov 1) and paid $60.00 a month until the end of April when he said he was coming to get it. Has been in our garage with my wife's Aurora sitting outside. With all the Hail and Tornado warnings I am some what it the dog house. I don't blame her and she wants $60.00 a month now. LOL
