New car nightmare
New car nightmare
My wife and I bought a new Kia optima.About 3 weeks later there was three lights came on on the dash 3 having to do with the brakes .Another having to do with the emissions. It ran fine but we took it to the dealers,They replaced practically the whole abs system ,both catalytic converters, and the engine. Now the car runs worse than ever with a definite mis on the low end and down on power .And everybody tell us it runs fine. What do I do now? It's still at the dealers and they want us to pick it up .My wife wants to but I say no if we pick it up then it's over.I told the one dealership I don't know how much they pay you but I couldn't do what you do there's no way I could look at somebody and just bold face lie.
If the car was a year or so old then it would different but it's brand new.At this point it's been at the shop more then with us.So anybody know what to do next?JP?Lawyer?

Something tells me this is either going to be a manufacturer or dealer buyback. Check the lemon law for PA here: http://www.dmv.state.pa.us/pdotforms...s/fs-lemon.pdf
I told my wife it sounded like the dearer was holding out wanting the manufacturer to make the call and the manufacturer was holding out wanting the dealer to make the call.because the one that makes the call is the one that loses. Is that right?

One thing I know for sure is that they hate to have it branded as lemon law. The manufacturer loses money in that case, and even more so due to the dealer doing the repairs and being paid for the warranty work.
Of course it is in their interest to keep you in the car. I recently saw a dealer buyback vehicle with the reasons labeled on the huge 8.5x11 sheet they had to tape to the front windshield. All kinds of prior problems...but the lot price was still close to what you could get one for after rebate. Made zero sense to me and I'm sure to 999/1000 people who shop. But they are looking for that 1 person who just can't resist and maybe doesn't have perfect vision...haha. Not funny, I know.

When they replaced the motor they kept it another few days because it had a ruff idle.I asked the dealer where's the record of what you did to fix the ruff idle because I think the problem we have know is the ruff idle, you didn't know what to do so you just said it runs fine and pushed it out the door.

Not sure if you could view that link that I posted or not since it was a pdf file...so here is the text from the most important part:
"Under the law, the manufacturer must, at no cost to the purchaser, repair or correct any defect which
substantially impairs the use, value or safety of the vehicle which occurs within one year after delivery, or
12,000 miles of use, or the term of the manufacturer’s express warranty, whichever comes first.
If the defect cannot be repaired in a reasonable time, you may be eligible for a replacement vehicle or the
refund of the purchase price, less a limited allowance for use.
First, contact the manufacturer’s zone representative at the telephone number listed in your vehicle’s owner
manual. If the zone representative is not successful in having the defect corrected, you may request an
arbitration of your case through the manufacturer’s dispute settlement program if one exists.
The arbitration decision is binding on the manufacturer, but not on the customer, who may proceed further by
bringing a private lawsuit.
If the manufacturer has not established an appropriate dispute resolution procedure, you may initiate a legal
action at the outset."

I was hoping to to get them "the garage people"in corner where they had to either admit they're lying or incompetent one or the other.I mean the mis on the bottom end, there is no way anyone could not feel it especially someone who is in that profession. The low power I can see because if you did'nt drive it be for ?
Oh one more thing Hagerstown Kia of Hagerstown Maryland
Have you talked to the Service Manager? Its a chain of command procedure next would be his regional manager. You can also try getting the new car sales manager involved. They can possibly trade you out of it with limited out of pocket expense. Stay civil and see if the dealer can make it right. I would assume if they replaced everything you say, it can be done as a lemon, be advised that route takes a while.
I bought my wife a new Kia Optima in September, a new 2014. When we got it home and washed it ourselves we noticed little impurfections all in the clear coat... everywhere. Long story short they couldnt buff it out so they were going to paint our 2 day old car. I wasnt happy but I agreed to it. When I brought it in to be painted the NEW manager says, you know this just isnt right, to buy a new car then have to have it painted. So we decided to give you the identical car in a 2015 model, same price, same everything. I really felt like they did the right thing, and did more than i ever expected out of a car dealer. Needless to say, that impressed me! So far the car has been great, drives good, runs good, handles good. We are leaving Sunday for California, San Luis Obispo, in the Kia. I hope we have no problems with it. My 89 year old father is going with us. My mother, brother, sister all live there, should be a blast.
Railguy I say bullshirt on your car dealer, they should give you a new car, no questions asked. I would be raising hell if it were me. Tell them you will be contacting your lawyer. Your buying a NEW car, not a piece of crap. You shouldnt have to go through this and they shouldnt expect you to. Im sure all makes have their lemons, but our new Kia is really good.... so far.

We did not fight the South Koreans, and I believe they have fought with us everywhere since the Korean war. They supplied the second largest amount of foreign troops to Vietnam, (US the largest), and sent troops to Iraq in 2004.
That said, what car is made with all US made parts and assembled totally here?

LOL! The last TV I bought that was American blew out in 2 years. Bye, bye to ALL the manufacturing jobs eventually. Then it will be, "Remember Detroit, Chicago, Philly, Cleveland, etc."
We can't play wage arbitrage with the world. 2 cents an hour in S. Korea? 65 dollars an hour in Chicago. Where you going to move your plant? That's my point. Remember the Alamo!

Plenty.
The Japanese had invaded their country, killed them by the thousands and made their women into sex slaves.
They had done the same to the Chinese, but make that "hundreds of thousands."
All the world was aware of it, so when the Japanese attacked us, there was no question that fighting, and fighting hard, was the only option.
The South Koreans fought with us on Pork Chop Hill, if not literally right on that hill, then all around us in other battles.
... And were absolute bastards, if their reputation is accurate - you did not want to be the poor SOB they were attacking, because they were merciless and tenacious fighters.
They were a great asset to our side, and loyal allies.

People often use the term, "With all due respect", right before they flambe somebody. You did just exactly that. Spend your money your way. Go to Burger King, in Germany.
To get this post back on track, many states have laws concerning cars with problems, when they are financed. I have been told that in some states, you don't have to pay the car loan, if the car is in the shop for warranty work for an extended time, although I have not been able to independently verify this. I did find the following on another website....
In the event you can't resolve the problem with the dealer, you can contact our firm by calling our toll free telephone number 1-800-MY-LEMON (1-800-695-3666), email us or complete our free lemon law case evaluation. We will do our best to resolve the claim with the automobile manufacturer as quickly as possible at no cost to you. Should the automobile manufacturer refuse to comply with lemon law requirements, we will promptly file suit on your behalf to seek compensation under the Pennsylvania Lemon Law and Federal Warranty Act. If your case settles, all fees and costs are paid by the manufacturer. Regardless of the outcome, you never pay any fees or costs.
You are still required to pay on the note as not doing so will damage your credit. Be prepared, going the Lemon law route takes a long time and the car will have to sit and not be used during this time.

Well I think I finally got some one to listen to me.
You wouldn't believe what kia has put us through. After the motor change. The car was not running right.we took it back but they said there was nothing wrong with it. We refused to pick it up. Finally they told us we had to. So we went to the dealership. I wanted someone to go with me for a test drive but no one was able. I took for a ride with my wife. It still did the same thing as before. I went to the monkey behind the desk and told him there has to be someone here who test drive anyone could tell it's not run in right. He said there isn't. I pointed to a guy with a mop and said what about him he said that's tell he janitor I said it doesn't matter anyone can see tell he his car is not running right. He told me if I wait ed someone be in later . so we waited. A mechanic came to my car . he agreed with me and I thought finally. So we got talk to the sells manager. And then we where back to square one it seems I lead the mechanic and they where disregarding his opinion. So I thought I had enough info that I could call kia on Monday and they would finally do something. Before I signed the papers to pick the car up I said I want you to make a note on the paperwork that the mechanic took it for ride and agreed it wasn't running right.they refused to do it. I thought perfect more ammo for me on Monday. Would you believe they still would not do anything. Well the car is at another dealership with the check engine light on and 2 codes. It sounds like they are finally believing me .I told them the problem the car has now is a result of the other problem I was telling you about for weeks if you fix this problem it's only going to come back until you fix the original problem. They agreed and said they will look into why Hagerstown kia couldn't find the problem. I no!! It's not that they couldn't reckignse a problem they refused acknowledge a problem a problem I told you and anyone who would listen to me too many to count now you I've got an even bigger problem and who knows what damage has been done I won't know about u till later.they said yes you're absolutely right and I'm going to a dress this with Hagerstown kia. I said I want you to also look into why the motor was change because I don't think it needed changed. They agreed to do that.
I only hope they're not lying to me again.
Trust me this is the short version of this story.

Damn Railguy, they just need to quit dicking aroung and give you a new car. Let that car be their headache not yours. We just drove my wifes 2015 Kia Optima from central Texas to California and back, almost 4000 miles, and the car ran flawlessly. Not even a hiccup. Averaged about 34 mpg, cruising at 85 mph most of the way. It seems to be a great car, unfortunately you seem to have gotten a lemon. That should not be your problem, Kia just needs to eat that car and give you a new one. I believe I would definitely seek legal help if they don't resolve this for you quick!
Well I talked to the service manager at battle field kia on Monday he said they found the problem big surprise it something Hagerstown kia did changing the motor. He wouldn't say that but he didn't say it wasn't either. I guess when they started the new motor for the first time there must have been fuel in the exhaust manifold .which broke it and sent pieces into the pre-catalytic converter which sent pieces into the catalytic converter the parts were supposed to be in today but I haven't heard from them. Tomorrow will be 4 weeks since they picked it up. I really have to give battle field credit they are trying and I hope succeeding to find the problem and not just saying there's nothing wrong it . and telling me that I'm just imaging it.
I told the service manager when they first got our car "make me like kia again ".but I'm pretty sure several biblical proffices will happen first.
