Sad demise of the CCRider (1992 Custom Cruiser(
Saturday night Juju and I out to the Balcony Club for an evening's entertainment listening to Kenny and the Kasuals (playing rock'n'roll for 50 years!). Got home about 9 PM, parked the CCRider ('92 Custom Cruisr) in her spot under the car port in front of the detached double garage, where the Silver Bullet resides inside (1968 FlatTop Wagon). Went to bed. Got up Sunday AM. reading the paper, and Ali, our next door neighbor called and asked "what the hell happened to the garage door"? Went outside, and S-H-O-C-K isn't the word! Leslie (daughter, 51 years old) evidently after having 3 drinks at the Royal Pour up on Garland Rd., sped down the driveway in a drunken stupor and plowed into the CCR. Moved that 4000 pound station wagon 5 feet (in park, no less) THROUGH the garage door and into the SB (don't know extent of damage to the SB, waiting on the garage door repairman to come out and install a new door today). Crumpled the hood badly, left front fender, and both sides of the tail gate, it won't budge. Basically, I suspect the insurance agent coming out today will declare it a total loss. I had no comp coverage on a 25 year old excellent Olds, my mistake. She had no insurance, of course. She moved out last night, at my not-so-calm direction. Very unfortunate, for us all. She's a recovering heroin addict, been clean for 17 years, but still has major issues (replaced H with methadone). Such a long story, and will stop now. Count your blessings, and thanks for letting me vent a little bit to the Oldsmobile Family.

The drugs are a sad story everywhere. My wife lost a daughter to heroin. I've got two sons who seem to be in trouble all the time with drugs, from meth to heroin. It's a nasty crisis on our country. I don't know what caused it, nor what the solution is going to be.

Damn Aron. I am so sorry for the lost of CCR and the damage to the Silver Bullet. I am even more sorry for the problems this has caused you and Juju. If there is anything I can do, please give me a call.

Dang, that's a real sad story all the way around. Does TX have an 'uninsured motorist' provision that you might be able to use to get some of the damages fixed?

Wow Aron- I hate to hear this.
Family or not, one truism of addicts is that they have no concept of responsibility toward others' property. I've forbidden a nephew to set foot on my property for any reason because of that. Things get damaged or worse go missing, and I got tired of chasing stuff down. He knows he's going to face criminal charges if he comes on the property, and I've notified all local pawn shops not to pawn anything he brings in, or I'll make sure they face charges and jail time too.
Sometimes you have to play hardball.

Sorry to hear about this. I don't know if you'd want to buy back the totaled CC and rebuild it. But here's a 1991 that's been for sale for a long time. The drivers door got crunched. Its in the neighboring town and would likely need to be shipped. But I could look at it for you if that might help. John

Breaks my heart. Silver lining is ... you're not posting from jail this morning. Good luck with the insurance.
Have to ask ... why is your daughter not in handcuffs this morning? She needs help your love can't provide. Next time, she might kill someone.

Sorry for your loss, both in trust in your daughter and the demise of your beloved car. I have to ask did you have classic car insurance on the wagon or just conventional insurance. Sure makes a difference when something like this happens.... Tedd

Liability
The State of Texas having secured all rights title and interest in an automobile will be ultimately responsible for any damages caused by an uninsured vehicle, look it up in the Civil Practice and Remedies Code, its there. Send the comptroller an invoice for your loss.

But you're right that no insurance company is going to pay to fix this car as it would cost more than the car's value, which is probably somewhere in the $3,000 to $4,000 range. They'll just give you a check for the value of the car.

Of course, this is assuming you didn't mean "collision" instead of "comp." People sometimes do forgo collision coverage on their own car, if it's old enough, to save money. The law requires that you have liability coverage to protect the guy you hit. The law does not care if you buy protection for your own car.
If that's what you meant, then you would get zero from the insurance company for your car and would have to seek restitution from the other driver. From what you say, your daughter does not have anything to restitute you with.

CCRider update
Still having mega pains over this whole thing. I had liability (pays for the other car), did not have comprehensive (what I've always called it) that paid for mine. Thank God did have uninsured, as my daughter's was just that. Looks as if AAA insurance is going to total the CCR. Heath (Funkwagon) advised me that a Member of the NTOC was going to sell his '92 CC (light blue with dark blue leather interior!); called Art and told him I will buy it, it's sold. Finally got the Silver Bullet out of the detached double garage, guessing 3-4K damage. Classic (Infinity) has been out and will cover with no deductible. Door replaced on the double garage (Hartford) in two days. Just got back in from a car show in Waxahachie and checked out the back of the garage, and the brick wall is moved about 1 1/2 to 2 inches off the foundation where the SB was pushed into it. Calling Hartford in the AM and letting them know we have more road to cover........................pics when I figure out how to get them off my cell on to my 'puter.....................!!!
